Welcome to InkoMenu. These Terms and Conditions ("Terms") govern your access to and use of InkoMenu's website, applications, and services. By using our service, you agree to these Terms. Please read them carefully before use.

1. Acceptance of Terms

By accessing or using the InkoMenu service, you confirm that: you have read and understood these Terms; you have the legal capacity to enter into binding contracts; you are at least 18 years old or have parental/guardian consent; you agree to comply with these Terms and all applicable laws. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.

2. Service Description

InkoMenu provides a digital menu platform for food service establishments, including: creation and editing of digital menus; multi-language support and automatic translation; QR code generation for customer access; menu view analytics; category and item management; menu appearance customization; integration with other services. We reserve the right to modify, suspend, or discontinue any part of the service.

3. User Accounts

To use the service, you must create an account. You agree to: provide accurate and current information; maintain password confidentiality; immediately notify us of unauthorized access; not transfer your account to third parties; not create multiple accounts to circumvent restrictions. You are responsible for all activities under your account.

4. Payment Terms

Payment for the service is made according to your selected plan: payment is charged at the beginning of each billing period (monthly or annually); prices are listed excluding VAT, which is added according to applicable law; we accept credit/debit card payments through Stripe secure payment system; subscriptions auto-renew unless cancelled; we notify you of price changes 30 days in advance.

5. Refund Policy

You may receive a full refund within 14 days of your first payment if the service does not meet your expectations. After 14 days: no refunds for unused periods; no refunds for downgrades to a lower plan; proportional refunds may be available for technical issues on our end. 6. Subscription Cancellation

You may cancel your subscription at any time through account settings. Upon cancellation: access continues until the end of the paid period; data is retained for 30 days after subscription ends; you can export your data before deletion; a free plan with limitations remains available. We will notify you via email before data deletion.

7. Usage Limits

Each pricing plan has limits: number of menus and items; number of languages for translation; image upload storage; monthly menu views; access to analytics features. Exceeding limits may result in temporary functionality restrictions or the need to upgrade to a higher plan. Current limits are listed on the pricing page.

8. Acceptable Use Policy

You agree NOT to use the service to: violate laws or third-party rights; distribute harmful, offensive, or illegal content; upload viruses, malicious code, or malware; attempt unauthorized access to systems; interfere with service operation or other users; collect personal data without permission; automate access without our written permission; resell or sublicense the service.

9. Intellectual Property

The InkoMenu service, including code, design, logos, trademarks, and content, is owned by InkoMenu and protected by intellectual property laws. You receive a limited, non-exclusive license to use the service. Content you upload remains your property, but you grant us a license to display it within the service. You warrant that you have rights to all content you upload.

10. Service Availability (SLA)

We strive to maintain 99.9% service availability. This excludes: scheduled maintenance (notified 24 hours in advance); force majeure events; user internet connection issues; actions of third parties beyond our control. For significant outages (over 24 hours), you may receive proportional compensation. Service status is available at status.inkomenu.com.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: InkoMenu is provided "as is" without warranties; we do not guarantee uninterrupted or error-free operation; we are not liable for indirect, incidental, special, or consequential damages; our total liability is limited to amounts paid by you in the last 12 months; we are not responsible for loss of data, profits, or reputation. Some jurisdictions do not allow liability limitations, so these may not apply to you.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. We do not guarantee that the service will meet your requirements or expectations.

13. Indemnification

You agree to defend, indemnify, and hold harmless InkoMenu, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from: your use of the service; your violation of these Terms; your violation of third-party rights; content you upload or distribute.

14. Termination

You may stop using the service at any time. We may suspend or terminate your access: for violation of these Terms; for non-payment; for suspected fraud or abuse; at law enforcement request; to protect other users. Upon termination: service access stops immediately; you may request data export within 30 days; rights and obligations that by their nature should survive will remain in effect.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles. For EU users: you retain rights under mandatory provisions of your country of residence. The UN Convention on Contracts for the International Sale of Goods does not apply.

16. Dispute Resolution

Before filing a lawsuit, parties agree to attempt to resolve disputes through negotiation for 30 days. If negotiations fail: for disputes under $10,000 - binding arbitration; for larger amounts - jurisdiction of Delaware state courts. You waive the right to participate in class actions. EU consumers may use the EU Online Dispute Resolution platform.

17. Changes to Terms

We may modify these Terms at any time. For material changes, we will notify you: via email 30 days before they take effect; through a notice on the service. Continued use after changes constitutes your acceptance. If you disagree with changes, you must stop using the service.

18. Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between you and InkoMenu regarding use of the service. If any provision is found invalid, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of it. You may not transfer your rights without our written consent.
